Abstract

This paper describes the concept of legal protection and human rights on Indonesian domestic workers, especially those working in Malaysia. This research is a normative juridical research using secondary data in the form of primary, secondary, and tertiary legal materials. Data were analyzed through conceptual approaches. The result shows that the legal and human rights protection against domestic workers is still not maximal, both in terms of the substance of the law and practices because the concept of legal protection has not been properly accommodated within the existing legal instruments. Properly, the concept of law and human rights protection of domestic workers should be based on international legal instruments. The important things to note in drafting legal protection of domestic workers is the protection of dignity, security, and legal certainty.
